SMPS CPA and AIA Pennsylvania are partnering again for a continuing education and networking event.  Anthony Potter, Esq. of

will present "Risk Management for A/E/C Marketing Professionals: Lessons Learned from Bidding and Proposals" on January 24th at the Appalachian Brewing Company's Abbey Bar in Harrisburg.  This presentation will focus on pre-contractual proposals and marketing materials supplied by A/E/C firms to Owners and how the representations may influence an arbitrator or jury in assigning responsibility for unanticipated costs associated with a construction project.  Increasingly, jurisdictions are finding that design professionals have an independent duty in tort to parties who foreseeably and justifiably rely on information that they provide.  Accordingly, responses to Requests for Proposal concerning A/E/C firm's capabilities must be carefully crafted and conscientiously prepared.  We will explore cases like the Community College of Philadelphia v. Burt Hill, Inc.

Learning objectives include:

  • Identify Potential Areas of Concern in Marketing Materials, Bids, and Proposals

  • Analyze Standard Forms of Construction Contracts

  • Discuss Roles and Responsibilities of Owners, Design Professionals, Construction Managers, and Contractors

  • Understand how recent decisions impact A/E/C firm's economic bottom line

Anthony S. Potter, Esq.

Anthony focuses his practice on the representation and counseling of architects, engineers, contractors, design-build entities, and other businesses in matters involving contracting, commercial and construction litigation, administrative law, and professional licensing.  Mr. Potter serves as general counsel to AIA Pennsylvania and is frequently called upon to provide seminars for design professionals on loss prevention, standard form construction contract documents, and construction litigation.  He has represented clients before the Commonwealth Court, the Supreme Court of Pennsylvania, the Third Circuit Court of Appeals, and the United States Supreme Court.
